Terms of Service

1. Agreement to Terms
By accessing or using Floatly ("the Service"), operated by Delyxa AS, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Floatly is a software-as-a-service platform that provides tools for managing Steam bot accounts, automating CS2 marketplace trading, tracking inventory, and generating financial reports. The Service does not custody, hold, or transfer any funds or virtual items on your behalf — it interfaces with third-party marketplaces and Steam on your instruction.
3. Eligibility
You must be at least 18 years old to use the Service. By using Floatly, you represent that:
- You are of legal age in your jurisdiction.
- You have the authority to enter into this agreement.
- Your use of the Service complies with all applicable laws, including those governing virtual item trading in your jurisdiction.
4. Accounts & Access
You are responsible for safeguarding your Floatly account credentials, Steam credentials, and any API keys stored in the Service. You must not share your account or allow unauthorized access. You are solely responsible for all activity under your account.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any third-party platform's terms of service (including Steam and connected marketplaces).
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Interfere with or disrupt the Service or its infrastructure.
- Use the Service to launder money, commit fraud, or engage in deceptive trading practices.
- Resell, sublicense, or redistribute access to the Service without written permission.
6. Third-Party Integrations
The Service connects to third-party platforms including Steam, CSGOEmpire, SkinDeck, Waxpeer, CSFloat, and others. Floatly is not responsible for the availability, accuracy, or policies of these platforms. Your use of third-party services is subject to their respective terms. If a marketplace changes its API, policies, or availability, we are not liable for resulting disruptions.
7. Fees & Billing
- Subscription fees are billed monthly or annually as stated on your plan.
- Usage fees apply only to completed sell transactions, as described in our pricing page.
- All fees are non-refundable unless required by applicable law.
- We reserve the right to change pricing with 30 days' notice.
8. Data & Security
Sensitive credentials (Steam secrets, marketplace API keys) are encrypted at rest using AES-256-GCM. We implement reasonable security measures but cannot guarantee absolute security. See our Privacy Policy for details on data handling.
9. Limitation of Liability
To the maximum extent permitted by law, Delyxa AS and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of virtual items, missed trades, or marketplace downtime, arising from your use of the Service.
Our total cumulative liability shall not exceed the fees you paid in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted, error-free, or that trades will execute successfully. Trading in virtual items carries inherent risk, and you assume full responsibility for your trading decisions.
11. Termination
Either party may terminate this agreement at any time. We may suspend or terminate your account immediately if you violate these terms. Upon termination, your right to use the Service ceases. We will make your data available for export for 30 days after termination.
12. Changes to Terms
We may update these terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use after changes constitutes acceptance.
13. Governing Law
These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Wyoming.
